Charge:

Aggravated Battery on a person 65 years or older, in violation of Fla. Stat. 784.08(2c)

Tried by:

Jury

Verdict:

Not Guilty

Personal Thoughts:

Another case improperly brought to trial by the State.  Here the defendant was perused by an older woman. She had passed him at a point and began break checking.  Eventually he passed her and she continued chasing him. The facts ended with him pulling off the road and pleading with the “alleged victim,” to leave him alone. The victim refused and placed herself between the door and the defendant wherein she fell roadside. Fortunately, patrons stopped their vehicles to assist. The victim improperly influenced three passerby's with her version after the defendant had left. Likewise, the officer failed to investigate and the defendant was arrested. Avoiding an offer of three years in prison a trial was held. The defendant was found not guilty.
